Terms of Service

These Terms of Service ("Terms") are an agreement between you and Tmember Club ("Tmember," "we," "us," or "our"), run by Rafael Jimenez in the United States. They cover your use of tmember.club (the "Site"), your membership, and everything we offer through them (together, the "Services"). By creating an account, becoming a member, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Who Can Join

You must be at least 18 years old and able to enter a binding contract to use the Services or become a member. You agree to give us accurate information and keep it up to date. You are responsible for your account, your password, and anything done under your login. Tell us right away at support@tmember.club if you think someone else has used your account. One account per person.

2. Membership and Billing

Price. Membership is $39 per month, billed automatically to your payment method each month until you cancel. We may change the price in the future. If we do, we will tell you in advance, and the new price applies from your next billing date after the notice. You can cancel before then if you do not want to continue.
Payment processors. Payments are handled by third-party payment processors. By joining, you authorize us and our processors to charge your payment method each month.
Failed payments. If a payment fails, we may retry it, pause your membership, or cancel it. Your membership is not active while a payment is unpaid.
Taxes. Prices may not include sales tax or other taxes, which will be added where required.

3. Cancellation and Refunds

Cancel anytime. You can cancel your membership at any time from your account or by emailing support@tmember.club. Canceling stops future shirts and future payments.
7-day refund window. If you cancel within 7 days of joining, you can request a full refund of your first payment.
After 7 days. Each shirt is made to order. After 7 days your shirt is in production, so payments already made cannot be refunded.
Chargebacks. Please contact us before disputing a charge with your bank. If you file a chargeback, we may suspend or cancel your membership while it is reviewed. A chargeback that reverses a referral's payment can also remove that share from the pool.

4. Shirts, Picks, and Shipping

Monthly pick. Each month, active members can pick a shirt from the catalog. You have 7 days after becoming a paid member to make your pick. If you don't pick in time, we choose a shirt for you.
Gifts. You can choose to send your shirt to someone else. Only give us their name and address if you have their permission.
Production and delivery. Production takes about 4 to 10 business days, and shipping usually takes another 4 to 7 business days within the U.S. International orders take longer. These are estimates, not guarantees.
Shipping fees. Shipping is free in the U.S., including Puerto Rico. An international shipping fee is added when you pick a shirt for delivery outside the U.S.
Addresses. Please check your shipping address. We are not responsible for orders sent to an incorrect address you gave us.
Damaged or wrong items. If your shirt arrives damaged, misprinted, or is the wrong item, email support@tmember.club within 14 days of delivery with a photo, and we will work with you on a replacement or another fair fix.
Colors and sizes. Colors on screen may look slightly different in person. Please check size details before you pick.

5. Referral Profit-Share Pool

The pool is an optional bonus for members. Tmember is a T-shirt membership first.

How it works. For each active paid membership, $9.50 goes into the monthly member pool. Each active paid member you personally refer gives you 1 share. At the end of each month, the pool is divided by the total number of active shares, and each share receives an equal part.
Eligibility. You must be an active paid member to earn. A new referral's payment is pending for 7 days before it counts as a share. If a referral cancels, gets a refund, or stops paying, you lose that share.
Payouts. The pool is calculated at the end of each month, and payouts are made between the 1st and 5th of the next month. We may require payout and tax information (for example, for a Form 1099 where the law requires) before we pay you, and we may hold payouts until we receive it.
No levels. Only your direct referrals earn you shares. There are no levels or downlines, and you never have to buy anything beyond your own membership.
No guarantee. All earnings figures, examples, and calculators on the Site are estimates only. Results vary, earnings are not guaranteed, and most members may earn little or nothing from referrals. See our Compensation Plan for details.
Honest promotion. When you share Tmember, do not make false or misleading claims, including promises of income. Do not spam, buy fake referrals, refer yourself, or create extra accounts. We may remove shares, withhold payouts, or close accounts tied to fraud or abuse.
Changes. We may change or end the pool program in the future. If we do, we will give members notice, and shares already earned for a completed month will be paid under the rules in place for that month.

6. Monthly Photo Contest

Active paid members may enter our monthly style photo contest. The contest is governed by its Official Rules, which are part of these Terms. By entering, you give Tmember permission to use your photo as described in the Official Rules and our Privacy Policy.

7. Community Rules

Our WhatsApp community and other channels are for members to connect and share. Be respectful. Do not harass anyone, post hateful, sexual, or illegal content, share other people's private information, or spam. We may remove anyone from our community channels who breaks these rules. WhatsApp's own terms also apply when you use WhatsApp.

8. Our Content and Designs

The Site, the Tmember name and logo, and all shirt designs are owned by Tmember or our licensors and are protected by law. Buying or receiving a shirt lets you wear and enjoy it. It does not give you the right to copy, resell, or reproduce our designs, logo, or content. You may share links to the Site and post photos of yourself wearing Tmember.

9. Your Content

If you submit photos, captions, messages, or other content, you confirm you have the right to share it and that anyone shown has agreed. You keep ownership of your content, and you give Tmember a worldwide, royalty-free license to use, display, and share it in connection with the Services and our marketing, as further described in the contest Official Rules.

10. Suspension and Termination

We may suspend or cancel your account if you break these Terms, commit fraud, file abusive chargebacks, or put other members or Tmember at risk. If we cancel your account for a reason other than your breaking these Terms, we will refund any payment for a shirt you have not yet received. You may stop using the Services at any time.

11. Disclaimers

The Services are provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will always be available or error-free.

12. Limitation of Liability

To the extent the law allows, Tmember will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or earnings. Our total liability for any claim related to the Services is limited to the amount you paid us in the 3 months before the claim. Some states do not allow these limits, so they may not fully apply to you.

13. Indemnity

You agree to cover Tmember for claims, losses, and costs (including reasonable legal fees) that come from your breaking these Terms, your content, or your misuse of the Services.

14. Disputes and Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Please contact us first at support@tmember.club so we can try to resolve any problem informally. If we can't, any dispute will be handled in the state or federal courts located in Seminole County, Florida, unless your local law gives you the right to bring it elsewhere.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top. If we make important changes, we will let you know, for example by email or a notice on the Site. Continuing to use the Services after an update means you accept the updated Terms.
